Abstract:

This paper presents the discourses about the Maria da Penha law enunciated by a sample of women victims and workers that attend gender violence in the city of Porto Alegre. These data are part of a study that investigated the critical route followed by women who decide to denounce violence. The statements were selected from 45 semi-structures interviews answered by 21 women and 25 professionals from police, legal, social and health services and nongovernmental institutions. Data were analyzed using NVivo software and one of the categories selected was the Maria da Penha Law. Most respondents mentioned the law in two aspects the positive and innovatory law aspects and limits of the law. Juridical workers realize the legal device as an important resource in dealing of violence, aligned with international conventions, bringing innovations and increasing women’s access to justice. How weaknesses, they point the inefficiency in the implementation of protective measures; moreover lack material resources and people, care network fragmented and the sexist movement in society to delegitimize the Law.
